These Terms of Service ("Terms") constitute a legally binding agreement between you and Crack Thump Pty Ltd ("Company," "we," "our" or "us") regarding your use of CodeMarine, our AI code security platform, including our website, software and related services (collectively, the "Service").

By accessing or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.

2. Description of Service

CodeMarine is an AI code security platform that analyzes code generated by AI assistants (including GitHub Copilot, Cursor, Claude and others) to identify security vulnerabilities, compliance issues and potential risks. Our Service includes:

  • Real-time code analysis and vulnerability detection
  • Security recommendations and remediation guidance
  • Integration with development environments and CI/CD pipelines
  • Reporting and analytics dashboards
  • API access and third-party integrations

3. User Accounts and Registration

3.1 Account Creation

To use certain features of the Service, you must create an account. You agree to provide accurate, current and complete information during registration and to update such information as necessary.

5. Subscription Plans and Payment

CodeMarine offers various subscription plans with different features and usage limits. Current pricing and plan details are available on our website.

5.2 Payment Terms

  • Subscription fees are billed in advance on a monthly or annual basis
  • All fees are non-refundable except as expressly stated in these Terms
  • We may change our pricing with 30 days' notice to existing subscribers
  • Failure to pay may result in suspension or termination of your account

5.3 Free Trial

We may offer a free trial period for new users. Trial accounts are subject to usage limitations and may be converted to paid subscriptions automatically unless cancelled.

6. Intellectual Property Rights

The Service, including all software, content, trademarks and other intellectual property, is owned by Crack Thump Pty Ltd and is protected by copyright, trademark and other intellectual property laws.

6.2 Your Rights

CodeMarine is operated from Australia. If you are accessing our services from outside Australia, your information may be transferred to, stored and processed in Australia and other countries where our service providers operate. We ensure appropriate safeguards are in place for international data transfers.

6.3 Feedback

Any feedback, suggestions or improvements you provide regarding the Service may be used by us without restriction or compensation.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.

9.2 Security Analysis Limitations

While CodeMarine helps identify security vulnerabilities, it does not guarantee detection of all security issues. You remain responsible for the security of your code and applications.

9.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE 12 MONTHS PRECEDING THE CLAIM.

10. Indemnification

You agree to indemnify and hold harmless Crack Thump Pty Ltd from any claims, damages, losses or expenses arising from your use of the Service, violation of these Terms or infringement of any third-party rights.

11. Termination

Either party may terminate these Terms at any time. Upon termination:

  • Your access to the Service will be discontinued
  • You remain liable for any outstanding fees
  • We may delete your account and data after a reasonable period
  • Provisions that should survive termination will remain in effect

12. Governing Law and Disputes

These Terms are governed by the laws of Australia. Any disputes arising from these Terms or the Service shall be resolved through binding arbitration or in the courts of Australia.

13. Changes to Terms

We may modify these Terms at any time. Material changes will be communicated to users with reasonable notice. Continued use of the Service after changes constitutes acceptance of the modified Terms.
